TestifyHubTerms of Service
These terms govern your use of testifyhub.cloud and the TestifyHub desktop application ("TestifyHub"), provided by ShipFast Solutions Pty Ltd ("we", "us"). By creating an account or using TestifyHub you agree to them.
1. The service
TestifyHub is desktop software for API and browser test automation. Accounts, licensing and support are provided through testifyhub.cloud. TestifyHub is currently in beta: features may change, and the service is provided without service-level commitments.
2. Accounts and trial
You must provide accurate information and keep your credentials secure. New accounts receive a 15-day trial. Licences are per user and limited to the number of devices stated in your account. Paid plans are coming soon; we will give notice before any charges apply.
3. Licence
We grant you a non-exclusive, non-transferable, revocable licence to install and use TestifyHub for your internal business purposes. You must not copy, resell, reverse engineer (except as permitted by law), or circumvent licensing controls.
4. Your content
You own your tests, data and reports, which are stored locally. You are responsible for the content you create and for having authority to test the systems you target. See the Acceptable Use Policy.
5. Fees
There are currently no fees. If paid plans are introduced, prices, billing cycle and renewal terms will be shown before you subscribe, and no charges will be made without your consent.
6. Availability and changes
We may modify, suspend or discontinue features, particularly during beta. We aim to give reasonable notice of material changes.
7. Termination
You may stop using TestifyHub and request account deletion at any time. We may suspend or terminate accounts that breach these terms or the Acceptable Use Policy.
8. Disclaimers
Subject to your rights under the Australian Consumer Law, which cannot be excluded, TestifyHub is provided "as is" and we do not warrant that it will be uninterrupted or error-free, or that testing will detect every defect.
9. Liability
To the maximum extent permitted by law, our total liability arising from your use of TestifyHub is limited to the greater of the amount you paid us in the 12 months before the claim and AUD $100, and we are not liable for indirect or consequential loss. Where the Australian Consumer Law applies, our liability for a failure to comply with a consumer guarantee is limited, where permitted, to resupplying the service or paying the cost of resupply.
10. Privacy
Our handling of personal information is described in the Privacy Policy.
11. Governing law
These terms are governed by the laws of Victoria, Australia, and the parties submit to the non-exclusive jurisdiction of its courts.
